OCCUPATIONAL HEALTH AND SAFETY IS NOT A PLUS, BUT A MUST. AT THE EXPENSE OF THE EMPLOYER.


  • 1. What is occupational health and safety?

    Occupational health and safety means the protection of workers from hazards: Employees must be protected from accidents at work, and work must not make them ill. Your employer must take measures to protect your health and safety at work.

  • 2. Why is occupational health and safety important?

    Maintaining good health is generally important for all of us. In addition, your health is important for you individually to be able to live a good life. This includes keeping your ability to work until you retire. For this to happen, damage to your health must be kept at bay. Occupational health and safety is a preventive instrument for this purpose. 

  • 3. What counts as occupational health and safety?

    Your employer must design your work and your workplace in such a way that hazards are avoided. Hazards to your life, physical health and mental health must be considered. This includes, for example, compliance with working hours, breaks, rest periods, work on Sundays and public holidays, on-call duties, shift work and holidays.


    Your employer must carry out a risk assessment of your work and working conditions to find out what measures are needed to protect you. 


    It is important that your employer stays up to date with the latest technology, occupational medicine and hygiene. In the current coronavirus pandemic, your employer cannot, for example, refer to a hygiene concept from the 2010s. This means that occupational science findings must also be taken into account for your protection. 


    Your employer must instruct you in occupational health and safety. 


    § 4 Ziff. 1, 3 und 7 Allgemeine Grundsätze Arbeitsschutzgesetz 

    Der Arbeitgeber hat bei Maßnahmen des Arbeitsschutzes von folgenden allgemeinen Grundsätzen auszugehen:

    1. Die Arbeit ist so zu gestalten, dass eine Gefährdung für das Leben sowie die physische und die psychische Gesundheit möglichst vermieden und die verbleibende Gefährdung möglichst gering gehalten wird. 

    3. bei den Maßnahmen sind der Stand von Technik, Arbeitsmedizin und Hygiene sowie sonstige gesicherte arbeitswissenschaftliche Erkenntnisse zu berücksichtigen.

    7. den Beschäftigten sind geeignete Anweisungen zu erteilen.


  • 4. Why is the observance of working time, breaks and rest/holiday time occupational health and safety?

    Working time is mentioned in the German Occupational Health and Safety Act as a factor that can pose a risk. For example, if breaks are not observed and lead to employees not being rested, the risk of accidents in the workplace can increase.

     

    There are legal regulations on working hours and holidays. If these are not observed, physical and mental stress can be the result. Your employer must therefore ensure that working hours are observed, otherwise he or she will also be in breach of the Occupational Health and Safety Act. 


    Working hours, overtime, rest periods and breaks are regulated by the Working Hours Act (see Working Hours). Holidays are regulated by the German Federal Holidays Act (see Holiday).


    § 5 Abs. 3 Ziff.1, 4, und 6 Beurteilung der Arbeitsbedingungen Arbeitsschutzgesetz 

    Eine Gefährdung kann sich insbesondere ergeben durch  

    1. die Gestaltung und die Einrichtung der Arbeitsstätte und des Arbeitsplatzes,

    4. die Gestaltung von […] Arbeitsabläufen und Arbeitszeit und deren Zusammenwirken,

    6. psychische Belastungen bei der Arbeit.


  • 5. I work in hospitality. Does health and safety apply to me?

    Occupational health and safety applies to all employees in the hospitality industry, including trainees. Your employer must protect all employees. Special protection applies to people with special needs, such as pregnant women and young people. Your employer may not differentiate between the sexes unless it is absolutely necessary from a biological point of view. 


    § 2 Abs. 2 Ziff. 1-2 Begriffsbestimmungen Arbeitsschutzgesetz

    1. Arbeitnehmerinnen und Arbeitnehmer,

    2. die zu ihrer Berufsbildung Beschäftigten […]


    § 4 Ziff. 6 und 8 Allgemeine Grundsätze Arbeitsschutzgesetz

    Der Arbeitgeber hat bei Maßnahmen des Arbeitsschutzes von folgenden allgemeinen Grundsätzen auszugehen: 

    6. spezielle Gefahren für besonders schutzbedürftige Beschäftigtengruppen sind zu berücksichtigen.

    8. mittelbar oder unmittelbar geschlechtsspezifisch wirkende Regelungen sind nur zulässig, wenn dies aus biologischen Gründen zwingend geboten ist.

  • 6. I am supposed to take part in a health and safety training course. What does that mean?

    Your employer is obliged to inform you about the occupational health and safety measures and to introduce them accordingly. After you have been instructed, you confirm with your signature that your employer has fulfilled this obligation.


    Only sign the instruction if your employer has also informed you about all the topics listed on the instruction. Get a copy of the instruction for your records and keep it. 


    § 4 Ziff. 7 Allgemeine Grundsätze Arbeitsschutzgesetz 

    Der Arbeitgeber hat bei Maßnahmen des Arbeitsschutzes von folgenden allgemeinen Grundsätzen auszugehen: den Beschäftigten sind geeignete Anweisungen zu erteilen.

  • 7. I have to wear protective clothing. Do I have to pay for this myself?

    A risk assessment of your workplace shows that protective clothing is necessary to perform your activities. Or an accident prevention regulation of the employers' liability insurance association prescribes protective clothing for your job. In both cases, your employer must cover the cost of the protective clothing. Note: Work clothing is not the same as protective clothing. (see Safety Standards: 8. I have to wear uniforms.     The works council has a right of co-determination in the selection of protective clothing (e.g. safety shoes).


    § 3 Abs. 3 Grundpflichten des Arbeitgebers Arbeitsschutzgesetz

    Kosten für Maßnahmen nach diesem Gesetz darf der Arbeitgeber nicht den Beschäftigten auferlegen.


    § 87 Abs. 1 Ziff. 7 Betriebsverfassungsgesetz

    Der Betriebsrat hat, soweit eine gesetzliche oder tarifliche Regelung nicht besteht, in folgenden Angelegenheiten mitzubestimmen: […] Regelungen über die Verhütung von Arbeitsunfällen und Berufskrankheiten sowie über den Gesundheitsschutz im Rahmen der gesetzlichen Vorschriften oder der Unfallverhütungsvorschriften.

  • 8. I have to wear uniforms. Do I have to pay for this myself?

    Work clothing is not the same as protective clothing. Therefore, it cannot be said across the board that it must be financed by the employer. As a general rule, employees must buy their usual work clothes themselves. If, on the other hand, special uniforms with, for example, company logos are to be worn, the employer usually bears the costs. The same applies to the cleaning of uniforms. 


    The hospitality industry has collective agreements that include agreements on uniforms. Check with the union for more information. 


    The works council has a right of co-determination in the design of uniforms. 


    If you have to buy and clean your work clothes yourself, you can claim this against tax. 


    § 87 Abs. 1 Ziff. 1 Betriebsverfassungsgesetz

    Der Betriebsrat hat, soweit eine gesetzliche oder tarifliche Regelung nicht besteht, in folgenden Angelegenheiten mitzubestimmen: Fragen der Ordnung des Betriebs und des Verhaltens der Arbeitnehmer im Betrieb.

  • 9. I had an accident during working hours. What happens now?

    If you have an accident during your working hours or on the way to or from work, these are occupational accidents. Report the accident to your employer. If you are unable to work for more than three days due to an accident at work, your employer must report the accident to the responsible employers' liability insurance association or accident insurance fund of the company. Also inform the works council. 


    Write down all the details of your accident: date, time, circumstances and witnesses. The statutory accident insurance is liable for any damage to health and consequences.

  • 10. What does the works council have to do with occupational health and safety in my company?

    The works council has important co-determination rights in occupational health and safety. Works councillors are therefore important contacts for employees with regard to occupational health and safety.


    Therefore, find out whether there is a works council in your company. 


    § 89 Abs. 1-2 Arbeits- und betrieblicher Umweltschutz Betriebsverfassungsgesetz

    (1) Der Betriebsrat hat sich dafür einzusetzen, dass die Vorschriften über den Arbeitsschutz und die Unfallverhütung im Betrieb sowie über den betrieblichen Umweltschutz durchgeführt werden. […]

    (2) Der Arbeitgeber […] [ist] verpflichtet, den Betriebsrat oder die von ihm bestimmten Mitglieder des Betriebsrats bei allen im Zusammenhang mit dem Arbeitsschutz oder der Unfallverhütung stehenden Besichtigungen und Fragen und bei Unfalluntersuchungen hinzuzuziehen. 

  • 11. I have Covid-19. Is this an occupational injury?

    In case of a confirmed case of coronavirus, contact the competent health authority and inform your employer and all people with whom you have had contact in the last week.
